1. Introduction

Welcome to Northern Lions Esports. By accessing www.northernlionsesports.nl and its related websites, services or tools (Collectively referred to as “Northern Lions Esports”) you are agreeing to the following terms. Northern Lions is provided to you by Northern Lions Esports, Kleine Hoogstraat 17, 8911HD, Leeuwarden, Friesland, Netherlands registered in the Dutch Chamber of Commerce (Kamer Van Koophandel) with number 72325305. These Terms of Use constitute a legally binding agreement between you and Northern Lions Esports and are effective as of 18/02/2021 for current users, and upon acceptance for new users.

2. Definitions

“User” and “member” means a person that has donated to get access to the Northern Lions Esports facility.

“Force Majeure Event” means any of the following events affecting multiple Users and Northern Lions Esports: acts of God, volcanic eruptions, (natural) disasters, fire, (acts of) war, hostilities or any local or national emergency, invasions, compliance with any order or request of any national, provincial, port or other public authority, government regulations or interventions, military actions, civil war or terrorism, (biological, chemical or nuclear) explosions, rebellions, riots, insurrection strikes, civil disorder (or the material or substantial threat or justified apprehension of any of the foregoing events), curtailment of transportation facilities, closing of airports or any other exceptional and catastrophic event, circumstance or emergency which makes it impossible or illegal for Users to travel to or stay at, or prevents Users from traveling to or staying at, the Northern Lions facility.

“Membership” means the result of donating to Northern Lions Esports to gain access to its facility.

3. About Northern Lions Esports

Northern Lions esports is an organization to which one can subscribe to get access to the facility of Northern Lions Esports and use the facility to play games on the various devices.

4. Using the facility

As a condition of your use of the facility you agree that you will not:

  • violate any laws;
  • post or otherwise communicate any false or misleading material or message of any kind;
  • infringe any third-party right;
  • distribute spam, chain letters, or promote pyramid schemes;
  • distribute viruses or any other technologies that may harm Northern Lions Esports or the interests or property of Northern Lions Esports customers;
  • harvest or otherwise collect information about others, including email addresses, without their consent;
  • bypass measures used to prevent or restrict access to Northern Lions Esports;
  • harass members or employees of Northern Lions Esports;
  • destroy any property owned by Northern Lions Esports or anyone else.Northern Lions Esports also reserves the right at our discretion to restrict a User’s usage of Northern Lions Esports either temporarily or permanently, or refuse a User’s registration. If it is believed that you are breaching these Terms of Use in any way and/or behaving suspiciously on the Northern Lions Esports websites, services, applications or tools, Northern Lions Esports may, at its discretion, inform other Northern Lions Esports users that have been in contact with you and recommend that they exercise caution.

    4.1 Rules about identity

    Northern Lions Esports members:

  • Can’t misrepresent their identities in any way.

  • Must provide valid and complete contact information and must always have a valid email address.

  • Can’t publish the contact information of other members in an online public area.

  • Have proof of identity available at the request of Northern Lions Esports with which the user has acquired a membership with.

4.2 Memberships – general

The membership in question works as a donation towards the non-profit organization Northern Lions Esports and for these donations you will receive access to the facility of Northern Lions Esports. The donation can be a one time donation for 1 or more months, or you can agree to have a membership lasting multiple months where you donate on a selected date each month. The price of these memberships may vary depending on the way you want to pay. These memberships are bound to one person’s name and can only be used by that individual.

4.3 Memberships – cancellations

At some point a user might want to cancel their membership for moments like these refer to the following parts to see what you can do to cancel your membership.

4.3.1 Cancellation types

Regarding the membership you have currently there can be a few different things you can do to cancel your membership.
For example you have a 6 month membership, after the 6 months are done the contract will freely continue, but you are free to cancel with 1 month notice. Meaning that once you have cancelled your membership you are required to pay for one more month. During this month you are still free to use the services provided by Northern Lions Esports.
In the case of you not having finished the 6 months of your 6 months membership it is impossible to cancel your membership. If for any reason you are unable to use the services provided there is an opportunity to pause the current membership provided that Northern Lions Esports deems the reason to be reasonable. During this pause payment is paused and so is the availability of the services provided by Northern Lions Esports. The rest of the contract is still to be fulfilled on a later date.

4.3.2 membership cancellation process

Once you decide on cancelling your membership you can begin the process by either mailing to hr@northernlionsesports.nl or by reaching out in person to any of the employees at the facility. Depending on the previously mentioned way one can cancel their membership they will either help you cancel your membership or make you aware of the fact that you cannot. If you are eligible then the process will start from this point on.

4.4 Force majeure event

In the event of a Force Majeure Event, the Membership shall not charge (and shall repay (if applicable)) the User affected by the Force Majeure Event any fee, costs, expenses or other amount for:
any cancellation or change of the Membership made by the User, or
that part of the Membership that was not consumed, due to the Force Majeure Event.
In the event of reasonable and justified doubt, the Fitness Provider may ask a User to provide reasonable evidence of the causality between the Force Majeure Event and cancellation or change of Membership (and provide Northern Lions Esports upon request with a copy of such evidence).

5. Abusing Northern Lions Esports

Without limiting other remedies, Northern Lions Esports may issue warnings, limit or terminate services, and take technical and legal steps to keep users away from Northern Lions Esports if it is believed that they are creating problems, infringing the rights of of third parties or acting inconsistently with the letter or spirit of our policies (including, without limitation, circumventing temporary or permanent suspensions or harassing the Northern Lions Esports employees or other users.

Northern Lions Esports may cancel unconfirmed accounts or accounts that have been inactive for a long time or modify or discontinue our Services. Additionally, Northern Lions Esports reserves the right to refuse or terminate all or part of our Services to anyone for any reason at our discretion.

6. Policy enforcement

When a Buyer or Seller issue arises, Northern Lions Esports may consider the User’s performance history and the specific circumstances in applying our policies. Northern Lions Esports may choose to be more lenient with policy enforcement in an effort to do the right thing for both buyers and sellers.

7. Privacy of other and marketing

If Northern Lions Esports provides you with information about another user, you agree you will use the information only for the purposes it is provided to you. You may not disclose, sell, rent, or distribute a User’s information to a third party for purposes unrelated to the Services. Additionally, you may not use information for marketing purposes, via electronic or other means, unless you obtain the consent of the specific user to do so.

8. Liability

You agree not to hold us responsible for things that other users do or say. Any damage done to our hardware or software while being operated by a member will result in that member being liable for any damage that has occurred.

Northern Lions Esports is not responsible for any physical or mental harm that may occur at any location owned or used by Northern Lions Esports.

Anything brought to a location owned or used by Northern Lions Esports is the user’s responsibility and as such Northern Lions Esports will not be held responsible when anything occurs to the item(s) brought to a location owned or used by Northern Lions Esports.

9. Release

If you have a dispute with one or more Northern Lions Esports users, you release us from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.

10. Personal information

By using Northern Lions Esports, you agree to the collection, transfer, storage and use of your personal information by Northern Lions Esports on servers. You also agree to receive marketing communications from us unless you tell us that you prefer not to receive such communications.

11. Resolution of disputes

If a dispute arises between you and Northern Lions Esports, Northern Lions Esports strongly advises you to reach out to Northern Lions Esports, using an email address registered with Northern Lions Esports. Northern Lions Esports will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

12. General

These terms and the other policies posted on Northern Lions Esports constitute the entire agreement between Northern Lions Esports and you, superseding any prior agreements. No agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement.

If Northern Lions Esports doesn’t enforce any particular provision, it is not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. Northern Lions Esports may automatically assign this agreement in our sole discretion in accordance with the notice provision below.

Except for notices relating to illegal or infringing content, your notices must be sent by a registered mail to Northern Lions Esports, Kleine Hoogstraat 17 8911HD Leeuwarden. Northern Lions Esports will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing.

Northern Lions Esports may update this agreement at any time, with updates taking effect when you next visit or 30 days after posting the updated policy on the Northern Lions Esports website, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.
